KALAMAZOO, Mich. (WOOD) – A 15-year-old has been charged with murder in the death of a 13-year-old Kalamazoo boy who was shot on Memorial Day evening while riding home on his bike.
The Kalamazoo County Prosecutor’s Office filed charges of open murder and felony firearm against Victor Manuel Garay in the death of Michael Day.
Michael was shot in the chest around 7 p.m. Monday near the intersection of Lay Boulevard and Race Street, police said. He later died at the hospital.
Prosecutor Jeff Getting said at a press conference Thursday afternoon that Victor Garay had been arrested around midnight. He said he had asked the court to hold the teen, but as of the press conference had not yet been informed of a decision.
A preliminary examination scheduled for June 3 will determine whether the 15-year-old will be charged as a juvenile or an adult.
“We’ll be looking at whether or not Mr. Garay has any prior history as a juvenile; if he does, what the charges are,” Getting said. “I’ll be looking for information about other contact with the police and the nature of those contacts, and trying to get as much information as possible regarding his background.”
The shooting is believed to have stemmed from an argument that took place over the weekend between two groups, police said. It’s unknown whether Michael was the intended target of the shooting.
Another person is being held as a person of interest in the case. Getting did not provide details about that person, but indicated more charges may be coming in the case.
