CASCADE TOWNSHIP, Mich. (WOOD) — An employee at a Grand Rapids-area restaurant faces a felony charge after allegedly hiding his cellphone in a restroom where he believed a female co-worker would change into her work uniform.

Brian Foster, 20, is charged with surveilling an unclothed person, a two-year felony. He waived a preliminary examination in 63rd District Court in Kent County on Wednesday.

The incident occurred at Moe’s Southwest Grill at 5070 28th Street SE in Cascade Township on Oct. 22, according to court documents.

The co-worker noticed a red light near the sink as she was changing and found a cellphone that was recording. She was able to view the image being recorded, which was of her changing into her work clothes and included images of her in her undergarments, according to a probable cause document.

Foster was questioned by police and admitted he intentionally recorded the woman changing in the restroom, court documents say.

He was released on a $750 bond. He is expected back in court later this month.
