GRAND RAPIDS, Mich. (WOOD) Many people don’t need an attorney unless something happens. But if you work, especially if you are an hourly employee working 40 hours per week, there is a kind of attorney you may want to call.

Avanti Law in Wyoming has a team that specializes in employment issues. There is an important change coming in the Fair Labor Standards Act that can change the amount of money a person is supposed to be paid legally.

If you make less than $455 per 40 hour work week, you should be getting overtime pay. Beginning December 1, 2016, the salary requirement will go up to $913 per 40 hour work week. After December 1, 2016, if you are not making $913 per 40 hour work week, you should be getting overtime pay.

Minimum Wage vs. Overtime Pay

  • Minimum wage – everyone should be making at least $8.50 per hour
  • Overtime pay – premium pay for any work over 40 hours per week
  • Employee should make time and a half or 1 ½ times their regular rate of pay for overtime pay

The law favors the employee and protects them. If an employee has to sue their employer for overtime pay they have not received, the employer is responsible for paying attorney fees. Avanti Law attorneys work on a contingency basis, so you don’t have to pay up front.

If you’re working more than 40 hours a week, call an attorney. The law is so complicated, it’s important to have a professional evaluate your case. A consultation is free and you’ll find out if you’re entitled to extra money.
